De centrale rol van de invoelbare ondraaglijkheid in de Nederlandse en Belgische euthanasiepraktijk is uniek in de wereld. Vanuit de Nederlandse toetsingsprocedure ken ik het belang ervan uit ervaring. Niet alleen is vereist dat artsen hebben vastgesteld dat iemand vond dat hij ondraaglijk leed, maar ook dat artsen dat zelf vaststellen. In zijn prachtige en doorwrochte artikel stelt Willem Lemmens terechte vragen bij de rol van ‘onuitputtelijke empathie’ (Thienpont) als basis voor een geassisteerd sterven voor psychiatrische patiënten. Met iemand meevoelen (...) zou op zijn minst een vermogen moeten impliceren om gevoelens te relativeren en in perspectief te plaatsen. Wat ik in deze bijdrage wil doen, is aan de hand van mijn ervaringen in de Nederlandse toetsingsprocedure illustreren hoe belangrijk Lemmens’ vragen zijn. Tegelijk zet ik twee kanttekeningen. Ten eerste: is er een manier om zonder een te grote nadruk op empathie toch euthanasiewensen van psychiatrische patiënten te honoreren? En ten tweede: stel dat we individuele psychiatrische patiënten wel euthanasie zouden gunnen, is daarmee ook het pleit voor een euthanasiepraktijk bij deze patiënten beslecht? (shrink)

Heidegger often stressed that the analysis of Dasein in Being and Time should be understood as a mere preliminary investigation. That this analysis indeed prepares the investigation into the relationship between time, the understanding of Being and ontology,can only become clear when some light is thrown on the never published third section ofBeing and Time. In this section Heidegger would have explicated in what sense time can be understood as condition of possibility for every kind of ontology. As ontology is (...) a specific possibility of human beings, this possibility must be based on the same basic structures as Dasein as such. In Heidegger's analysis of Dasein, the distinction between a proper and an improper mode of existence is understood as based on a different temporalisation of temporality. Improperness results from a temporal movement in which presentness takes the upper hand and determines the way Dasein understands beings, other people and itself. In the proper mode of existence on the other hand, not only presence, but the three ecstasies of time as a whole would constitute the openness of Dasein. Heidegger would have demonstrated in the third section that this same temporal difference also forms the condition of possibility for the improper and proper mode of ontology: the so-called metaphysics of presence and Heideggers own temporal ontology respectively.From the rather formal perspective of our interpretation, the different moments of the analysis of Dasein are read in view of their significance for the investigation into the essence of metaphysics. By doing so, the third section appears to be the aim of Heidegger's questioning and the 'missing link' between the analysis oí Dasein and the destruction of traditional metaphysics. When Being and Time is read with such a focus on the third section, the often used distinction between the early and the later Heidegger looses much of its sharpness, if not its relevance: it is already in Being and Time itselfthat Heidegger tries to decenter the human being in behalf of a temporality that constitutes meaningful openness as such. Confrontatie van enkele varianten van de fenomenologische methode met de ideologie-kritiek, de hermeneutiek en de retoriek.

Medical research involving human subjects can be risky and burdensome. Therefore, such research must be reviewed and approved by a Research Ethics Committee (REC). To guarantee the safety of the subjects, it is very important that these studies be conducted in accordance with the approved protocol. An important issue in this respect is whether studies include the requisite number of subjects based on the research question. The research question is unlikely to be answered reliably if the requisite number of subjects (...) is not met. In such cases, subjects are exposed to unnecessary risks and burdens. In this descriptive study, the authors evaluated how frequently studies are completed with the required number of subjects. Moreover, the authors identified the characteristics of research that does and does not include the required number of subjects. The results of this study show that a considerable proportion of studies (41/107) were terminated although they failed to recruit a sufficient number of subjects. Furthermore, the authors found that investigator-initiated studies have significantly (p=0.028) more problems in recruiting the requisite number of subjects than studies initiated by pharmaceutical companies. Potential solutions are discussed to reduce the number of studies that do not include a sufficient number of subjects. (shrink)

Inleiding tot de wijsgerige ethiek, met bijzondere aandacht voor het kantiaanse perspectief.

De geopolitieke spanningen aan het begin van de eenentwintigste eeuw hebben een nieuwe interesse in het werk van Carl Schmitt gewekt. Dat geldt ook voor zijn benadering van het vraagstuk van de relatie tussen religie en politiek. Schmitt zoekt hierbij aansluiting bij zulke uiteenlopende en incompatibele auteurs als Juan Donoso Cortes en Thomas Hobbes. Vooral recent onderzoek heeft duidelijk gemaakt dat Schmitts juridisch-politieke denken inderdaad steunt op een aantal politiek-theologische premissen. Toch moeten we de actualiteit van zijn werk vooral zoeken (...) bij zijn politiek-filosofische probleemstelling die aanhaakt bij Thomas Hobbes. Schmitt kan ons vooral leren dat de privatisering van de religies als middel voor hun politieke neutralisering haar grenzen heeft, vooral in een democratische politieke orde. (shrink)

Deze studie wil de wijsgerig-ethische stromingen van de 19e en 20e eeuw op een overzichtelijke wijze presenteren. Zij biedt veel en ongetwijfeld kan zij dienst doen als een eerste oriëntatie. De continentale filosofie komt goed aan de orde, zij het dat de auteurs de aandacht voor de bibliografische notities vaak laten gaan ten koste van de toch al summiere inhoudelijke inleidingen. De auteurs beschrijven en beoordelen - dikwijls in moraliserende termen - maar gaan niet in dialoog noch met de behandelde (...) auteur noch met de lezer. De angelsaksische wereld komt nauwelijks aan de orde (29 blz.). De betekenis van de analytische ethiek voor de normatieve ethiek wordt niet gezien. Het boek stopt ook te vlug. De recente ontwikkelingen komen niet aan de orde. Over narratieve ethiek wordt niet gesproken. Maar evenmin over de hernieuwde aandacht voor de deugden-ethiek. Deze studie laat duidelijk zien dat de gigantische onderneming om een goede inleiding in de wijsbegeerte en de ethiek van de 19e en 20e eeuw te schrijven, niet door een of twee personen kan worden voltooid. BackgroundIn the Netherlands, patients have the legal right to make a request for euthanasia to their physician. However, it is not clear what it means in a moral sense for a physician to receive a request for euthanasia. The aim of this study is to explore the moral values of physicians regarding requests for euthanasia. MethodsSemi-structured interviews were conducted with nine primary healthcare physicians involved in decision-making about euthanasia. The data were inductively analyzed which lead to the emergence of themes, (...) one of which was about values regarding end-of-life decisions.ResultsFour clusters of values related to euthanasia requests are described: values related to 1) the patient; 2) the family; 3) the physician; and 4) life and death. The data show that the participants value patient autonomy as a necessary but not sufficient condition for meeting a euthanasia request. A good relationship with the patient and the family are important. For the physician, the values physician autonomy, responsibility, understanding the patient and relief of suffering play a role. Life as an intrinsic good and a peaceful death are also important values.ConclusionThis study shows that next to patient autonomy and the relationship with the patient and the family, it is important for the participants to act in accordance with their professional values and to do justice to values related to life and death. The awareness of going against the intrinsic value of life is crucial, even if performing euthanasia may result in a feeling of relief or gratitude afterwards. (shrink)

Ook al staan de beelden van Confucius, Lao Zi en Boeddha in sommige Chinese tempels weer broederlijk bijeen op het altaar, hun verschillende wegen tot zelfcultivering worden zelden in onderlinge samenhang beschreven. Dit boek benadert confucianisme, daoïsme en het Chinese boeddhisme in zijn vroege ontwikkeling vanuit hun visie op de praktijk van de zelfcultivering. Hoewel ze een volstrekt ander doel hebben dan de westerse zelfverwerkelijking, mogen de Chinese wegen zich in onze contreien toch in een grote populariteit verheugen. Omdat de (...) zelfcultivering in China primair gericht is op de emoties, vormt de emotiecultivering de rode draad in dit boek. Het begrip Qi, levenskracht, speelt een grote rol in alle cultiveringspraktijken en staat centraal in het klassieke Chinese denken. Het eerste hoofdstuk biedt een inleiding in dit begrip, waardoor de lezer een overzicht krijgt van een aantal Chinese kernconcepten en theorieën en daarmee ook van de context van de emotiecultivering. Naast de beschrijving daarvan in confucianisme, daoïsme en boeddhisme biedt het boek verder een beschouwing van de Chinese landschapsschilderkunst als "filosoferen met het penseel". Het slothoofdstuk vat de verschillende cultiveringspraktijken samen en presenteert ze onder de noemer van Wegen naar het Midden. (shrink)

After having defined the KARO logic for specifying intelligent agents in earlier work we now turn to the question how to realise agents specified in the KARO framework. To this end we look at agent programming languages that we have defined, and investigate how programs in these languages can be linked to the KARO logic.

Background In neonatal intensive care, a child's death is often preceded by a medical decision. Nurses, social workers and pastors, however, are often excluded from ethical case deliberation. If multiprofessional ethical case deliberations do take place, participants may not always know how to perform to the fullest. Setting A level-IIID neonatal intensive care unit of a paediatric teaching hospital in the Netherlands. Methods Structured multiprofessional medical ethical decision-making (MEDM) was implemented to help overcome problems experienced. Important features were: all professionals (...) who are directly involved with the patient contribute to MEDM; a five-step procedure is used: exploration, agreement on the ethical dilemma/investigation of solutions, analysis of solutions, decision-making, planning actions; meetings are chaired by an impartial ethicist. A 15-item questionnaire to survey staff perceptions on this intervention just before and 8 months after implementation was developed. Results Before and after response rates were 91/105 (87%) and 85/113 (75%). Factor analysis on the questionnaire suggested a four-factor structure: participants' role; structure of MEDM; content of ethical deliberation; and documentation of decisions/conclusions. Effect sizes were 1.67 (p<0.001), 0.69 (p<0.001) and 0.40 (p<0.01) for the first three factors respectively, but only 0.07 (p=0.65) for the fourth factor. Nurses' perceptions of improvement did not significantly exceed those of physicians. Conclusion Professionals involved in ethical case deliberation perceived that the process of decision-making had improved; they were more positive about the structure of meetings, their own role and, to some extent, the content of ethical deliberation. While having a breast reconstruction, women have certain expectations about their future breasted bodies. The aim of this paper is to describe and analyze these expectations in the process of reconstruction. By applying a qualitative, phenomenological study within a longitudinal research design, this paper acknowledges the temporarily complex, contextualized, embodied, and subjective nature of the phenomenon of expectations. The analysis identified expectations regarding three different aspects of women’s embodiment: their gazed body, their capable/practical body, and their felt body. After reconstruction, (...) these women try to reconfigure—adjust, level or retrospectively rewrite—their expectations. Further, some women face what apparently arrives totally unexpected, namely a strange feeling breast or a failed reconstruction. The development of these women’s expectations can be understood as an active, continuously evolving, difficult and sometimes impossible dynamic of expecting the surprise that is a breast reconstruction. Within this dynamic, women formulate and reconfigure—by definition—unrealistic expectations and validate and try to achieve unexpected futures. We suggest that medical professionals can facilitate this dynamic in various ways. (shrink)

Verrassend misschien voor filosofen buiten Frankrijk, maar in Parijs is wetenschap altijd een object van filosofische reflectie geweest – niet in de vorm van de analytische wetenschapsfilosofie zoals die buiten Frankrijk wordt onderwezen, maar onder de noemer van historische epistemologie, of soms ook wel kortweg épistémologie genoemd. Dit themanummer wil een inleiding zijn op deze traditie in haar denkers.

Moet er strenger gestraft worden of juist niet? Mag de rechter door de wetgever aan banden worden gelegd? In hoeverre mag de overheid ingrijpen in het privéleven van haar burgers? Deze vragen zijn inzet van menig opiniërend krantenartikel of discussieprogramma. Ook degenen die zich beroepshalve met het recht bezighouden zullen zich van tijd tot tijd moeten bezinnen op taak en functie van het recht. Moeten we regels toepassen als ze tot onrechtvaardige uitkomsten leiden? Leiden regels wel tot het doel waarvoor (...) ze zijn opgesteld? Dit zijn allemaal vragen over het recht waarop door het recht zelf geen antwoorden kunnen worden gegeven. Betekent dit dat discussies over deze kwesties zinloos zijn omdat zij ontaarden in politieke welles-nietes spelletjes? Deze inleiding in de rechtsfilosofie beoogt te laten zien dat dit niet hoeft. In deze tijd van secularisering is het begrijpelijk dat men de filosofie van de religie vaak wil beperken tot een kritiek van de religie en tot de kritische bespreking van de bekende godsbewijzen. 0Dit handboek kiest voor een andere aanpak. De filosofie van de religie is geen monolithische discipline. Filosofie van de religie is soms een binnen-religieuze aangelegenheid waarin de filosofie wordt ingezet als een hulpwetenschap voor de theologie, soms gaat het om een zuiver rationele aangelegenheid, soms domineert een naturalistische (...) blik en soms poogt men vooral de betekenis van het religieuze te verhelderen. Al deze modellen van filosofie van de religie komen hieraan bod en worden in hun historische ontwikkeling besproken. Daarom vertrekt dit handboek niet van de 'gedachte God' van metafysici en wetenschappers ('des philosophes et des savants', Pascal), maar veeleer van de geleefde religie ('la religion vécue', 'lived religion') om na te gaan hoe het religieuze in de praktijk functioneert en wat de betekenis ervan is: "Wat betekent het religieus te zijn?" is een belangrijker vraag dan "Is religie waar?". Nu we de totale vrijheid hebben bereikt, heeft het weinig zin meer om over zonden te spreken. Als vanzelf wordt het toch weer interessant om over deugden na te denken: een positieve eigenschap waarover we beschikken of een goede manier van handelen. Rik Torfs treft die deugden aan op onverwachte momenten, wanneer we ons met humor proberen te beschermen, de eindeloosheid van onze wereld toch begrenzen of eenvoudigweg praten met elkaar. Even scherpzinnig als verontrustend beschrijft Torfs hoe wij, hypermoderne mensen, (...) meer mens proberen te zijn en hoe we onderweg het spoor bijster raken. Een teveel aan rationaliteit ligt volgens hem bijna altijd aan de basis van overspannen gevoelens over onszelf en foute inschattingen van de wereld, of het nu gaat over de manier waarop we ons persoonlijke geluk benaderen, over migratie denken of met onze eigen sterfelijkheid omspringen. Net omdat mensen geen rationele of volmaakte wezens zijn, is het beter om van de nood een deugd te maken. (shrink)

Pas de deux with a theological legacy. Jürgen Habermas on David Hume and Immanuel Kant In his latest opus magnum, Jürgen Habermas reconsiders the history of philosophy from a peculiar perspective: the true and unique nature of philosophy is shown to have been given shape in philosophy’s dispute with Christian theology. This article reviews Habermas’ chapter on the Enlightenment, in which Habermas casts David Hume and Immanuel Kant dancing their own pas de deux with that theological legacy. After having sketched (...) the historical scripts in which Hume and Kant are involved by Habermas, I will critically assess the author’s claim that while Hume ends up refusing the dance and (hence) betraying (enlightened) philosophy’s nature, Kant accepts and transforms the heritage, yet ends up failing to give his pas de deux a genuine modern and enlightened twist. The current crisis makes it clear that the financial sector has an ever greater impact on national and international politics. This development poses a challenge not only to Europe, but also to our philosophical understanding of the relationship between politics and the market. In order to use Hegel’s Philosophy of Right for the purpose of reflecting on this relationship, I begin by arguing that recent commentators, including Honneth and Pippin, unduly play down Hegel’s critique of the liberalist conception of freedom (...) as well as the conception of the state that follows from this critique. Turning to Hegel’s analysis of the relationship between civil society and the state, I submit that we can learn from Hegel that it is crucial for modern societies to let citizens pursue their own interests, but that a one-sided focus on this element threatens to undermine the society as a whole. This is the case if the political domain, which ought to be devoted to the long-term interests of the society as a whole, fails to sufficiently distinguish itself from the struggle between contending particular interests that characterizes civil society. Depletion of mitochondrial endo/exonuclease G‐like (EXOG) in cultured neonatal cardiomyocytes stimulates mitochondrial oxygen consumption rate (OCR) and induces hypertrophy via reactive oxygen species (ROS). Here, we show that neurohormonal stress triggers cell death in endo/exonuclease G‐like‐depleted cells, and this is marked by a decrease in mitochondrial reserve capacity. Neurohormonal stimulation with phenylephrine (PE) did not have an additive effect on the hypertrophic response induced by endo/exonuclease G‐like depletion. Interestingly, PE‐induced atrial natriuretic peptide (ANP) gene expression was completely abolished in endo/exonuclease (...) G‐like‐depleted cells, suggesting a reverse signaling function of endo/exonuclease G‐like. Endo/exonuclease G‐like depletion initially resulted in increased mitochondrial OCR, but this declined upon PE stimulation. In particular, the reserve capacity of the mitochondrial respiratory chain and maximal respiration were the first indicators of perturbations in mitochondrial respiration, and these marked the subsequent decline in mitochondrial function. Although pathological stimulation accelerated these processes, prolonged EXOG depletion also resulted in a decline in mitochondrial function. At early stages of endo/exonuclease G‐like depletion, mitochondrial ROS production was increased, but this did not affect mitochondrial DNA (mtDNA) integrity. After prolonged depletion, ROS levels returned to control values, despite hyperpolarization of the mitochondrial membrane. The mitochondrial dysfunction finally resulted in cell death, which appears to be mainly a form of necrosis. In conclusion, endo/exonuclease G‐like plays an essential role in cardiomyocyte physiology. Loss of endo/exonuclease G‐like results in diminished adaptation to pathological stress. The decline in maximal respiration and reserve capacity is the first sign of mitochondrial dysfunction that determines subsequent cell death. (shrink)
